1. General Provisions
This public offer (the "Agreement") is an offer from AGENYZ TRADING LTD (registration number HE 394232, address: 4, Kleanthi Mesologgiti, Larnaca, 6051, Cyprus) (the "Seller") to conclude with any individual registered on the Site (the "User") a contract for the retail sale of Goods on the terms and conditions of this public offer.1 In accordance with the User Agreement, any adult and/or legally capable individual may register on the Site and become a User.
This Agreement contains all essential terms of the retail sale contract. This Agreement is a contract of adhesion, the terms of which are defined by the Seller and can be accepted by any User only by adhering to this Agreement as a whole.1 Unconditional acceptance (acceptance) of the terms of this Agreement shall be deemed to be the actions of any User to place an Order for Goods on the Site and click the "Pay" button. From the moment of acceptance, the User becomes a Buyer and is considered to have entered into a contractual relationship with the Seller on the terms of this Agreement.
This Agreement, concluded by the User's acceptance of this public offer, does not require bilateral signing in the form of a separate document. If the User does not agree with the terms of this Agreement, they should refrain from placing an Order.
2. Terms and Definitions
● Agreement: This public offer.
● Seller: AGENYZ TRADING LTD.
● User: A registered individual on the Site
● Buyer/Client: A User who has placed and paid for an Order.
● Site: The website with the domain https://agenyz.eu/.
● Goods: Products offered for sale by the Seller.
● Order: The User's action of selecting and purchasing Goods through the functionality of the Site.
3. Subject of the Contract
The Seller undertakes to transfer the Goods into the ownership of the Buyer, and the Buyer undertakes to pay for and accept the Goods ordered on the Site. The name, assortment, quantity, and total cost of the Goods shall be specified in the Buyer's Order.
4. Order Placement
Ordering is carried out by a registered User through the functionality of the Site. The User is responsible for the accuracy of the information provided. The Order cannot be changed after payment.
There are two ways to make an order on the agenyz.eu site. You can register on the site and receive your own personal customer ID. You can also make an order without registration; this is possible if one of our Promoters sends you a promo code or referral link. If you don’t have such a promo code you can use “freecustomer”.
5. Quality and Completeness of Goods
The Seller guarantees the quality of the Goods in accordance with the requirements established by the applicable laws of the Republic of Cyprus and relevant EU regulations.1 The completeness of the transferred Goods shall comply with the terms of the Buyer's Order.1
6. Price of Goods and Payment Options
The price of the Goods is indicated on the Site and may be linked to the User's Personal Account in accordance with the Company's loyalty program. All settlements are in Euros (EUR). Payment for the Order, including the cost of Goods and delivery, is made on a 100% prepayment basis.1
Payment Options:
We accept payment by Visa and Mastercard. Online payment requires your credit (debit) card information (card number, three-figure CVV-code, expiration period) and payment amount.
The procedure of monetary funds withdrawal is carried out after order receipt in the e-shop or within a few hours after.
Your order will be placed immediately after payment confirmation. The confirmation process usually takes several minutes.
7. Delivery Terms
1. Delivery of ordered and paid goods occurs through our logistics partners FedEx, DHL and Cyprus Data Post.
2. The client shall be responsible for the proper data provisions (address, e-mail, telephone), otherwise, the delivery of goods cannot be guaranteed. The Client shall inform the Seller by e-mail of any changes, not later than within 24 hours from the moment of the order confirmation.
3. The order is automatically assigned with the order number after placing it in the e-shop and a corresponding notification is sent to your e-mail address.
4. The order preparation period takes 1–2 working days after payment confirmation.
5. After the order has shipped you will get the tracking number via email or you can find it in the «Orders history» in your account (and/or you will receive information directly from our logistics partners).
6. If we cannot deliver the goods you ordered, we can cancel this agreement and fully refund your money to you. We will inform you that we cannot deliver the goods to you by sending an email to you.
7. We will arrange the delivery of ordered goods on our website in full accordance with your order. Your order will be shipped via courier service or post. If you are unavailable during delivery time, courier services will contact you to specify the time of receiving the goods. Shipping costs are paid at the same time as payment for the order.
8. Each order is accompanied by an invoice containing the terms of payment, the name of the purchased products, and other documents that may be required in accordance with the situation or applicable law.
9. The time frame of delivery will depend on the destination and availability of the client at the designated address. For EU countries the delivery time is estimated from 3 days up to 2 weeks from the issuance of an order. For non-EU countries, the estimated time is up to 3 weeks. For delivery Worldwide it can take up to 10 weeks depending on location. If the parcel is not delivered within this period, the client is offered an option to receive a credit note or to agree on a prolonged delivery time. Delivery times depend on the logistics operator you have chosen; you can see the approximate delivery time at the moment of placing the order.
10. DELIVERY OUTSIDE OF THE EUROPEAN UNION (EU): Customs and Import charges may apply during the import into your country. Please ask your Customs Officials about Charges and Import regulations before ordering. Agenyz is not responsible for any Customs and Import charges which may apply.
11. The Company shall not take responsibility for unpredicted circumstances that will prolong the delivery and are not under the control of the Company (such as political barriers due to disputes between some countries, unacceptable customs requirements by the receiver etc.). By making purchases in our online Store the client is considered to be in acceptance with our Terms and Conditions.
8. Transfer of Goods and Title
Title to the Goods and the risk of accidental loss or damage pass from the Seller to the Buyer upon actual receipt of the Goods by the Buyer or their designated recipient.
9. Refusal and Return Policy
The Client can use the right of refusal and return the goods within the period prescribed by the national legislation of the country of the Client. In order to avoid disputable situations, at the moment of receipt of Goods, the Client should verify whether the Goods meet the order (product name and other relevant parameters). The cost of postal/courier services for the return shall be covered by the Client.
1. If the Client wants to use their right of refusal, the following recommendations and requirements should be taken:
1.1. Returned goods should not be used (taking into account the specifics of the Goods). If the condition of the returned goods has deteriorated due to the Client’s actions, the Client has no right to use the right of refusal.
1.2. The Client shall be obliged to maintain and not damage the original package of the Goods.
1.3. If the Client wants to use their right of refusal, they should contact the Seller by e-mail.
1.4. The Client shall keep both the postal/courier service documents on receipt of the Goods and the postal/courier service documents on the return of goods to the Seller.
1.5. Money for the returned goods and services shall be transferred by the Seller to the bank account of the Client within 30 (thirty) calendar days from the date of refusal.
1.6. After the expiration of the above-mentioned period, the Client has no right of refusal.
2. If you receive a damaged package, make a complaint immediately with the delivery person and refuse to take the package. Also, contact us and we will send you a replacement for the damaged goods free of charge.
3. If we made a mistake and you did not receive the items you ordered or if the items you received are damaged, please call us or write an email with a picture of the damaged product. Simply fill out the provided return form and ship it back to us together with the items carefully packaged. After receiving the exchange or replacement shipment you are required to return the original shipment within 30 days. In any case, we will cover the cost and risk of the return shipment.
10. Invoice
An invoice confirming payment for the Order will be sent to the Buyer in electronic form to the email address confirmed by the Buyer during registration on the Site. The Seller's obligation to provide the invoice is fulfilled from the moment the invoice is sent.
11. Liability of the Parties
For non-performance or improper performance of their obligations under this Agreement, the Parties shall be liable in accordance with the applicable laws of the Republic of Cyprus.1 The Seller is not liable for damage caused by improper use of the Goods.1 The Parties are released from liability for non-performance due to force majeure circumstances.
12. Personal Data
The collection and processing of the Buyer's personal data are regulated by the Seller's Privacy Policy, which is compliant with the General Data Protection Regulation (GDPR).1 By placing an order, the Buyer acknowledges that their personal data will be processed for the purpose of fulfilling this Agreement.1
13. Applicable Law and Dispute Resolution
This Agreement and the relationship between the Seller and the Buyer are governed by the laws of the Republic of Cyprus.1 All disputes shall be resolved through negotiations. If a dispute cannot be settled, the courts of the Republic of Cyprus shall have jurisdiction.
14. Procedure for Amending this Agreement
This Agreement may be amended by the Seller at any time. Changes come into force upon publication on the Site. Placing an Order after changes have been published constitutes acceptance of the new terms.
15. Final Provisions
If any provision of this Agreement is found to be invalid, the remaining provisions will remain in full force.1 The Buyer warrants that they understand and accept all terms of this Agreement unconditionally.
